% 03.05.2016 Learned counsel for the petitioner under instructions from the husband of the petitioner Kamal Bhola (present in Court) states that the petitioner does not wish to file the undertaking in terms of directions of this Court dated 04.03.2016. He also seeks permission of this Court to withdraw his power of attorney. The husband of the petitioner who is present in Court has no objection to the same. Per contra, learned counsel for the respondent points out that this petition has become infructuous in view of the fact that the matter has now almost at the stage of final arguments and the order-sheet dated 18.04.2016 noting this has been placed on record. This Court notes that after the date of the impugned order i.e. after 25.05.2015, the matter was listed before the Trial Court where the Trial Court had noted that the petitioner/defendant is seeking to retract from the offer4

of compromise which had been made before this Court. The statement of the defendant that he is not interested in any settlement had also been noted. On that date, PW-1 had been cross-examined and discharged. PE stood closed and since the defence of the defendant had already been struck off, the matter had been posted for final argument.

Learned counsel for the respondent rightly points out that this petition has become infructuous. It is disposed of accordingly. INDERMEET KAUR, J MAY 03, 2016
