O R D E R
% 27.05.2016 Counsel for the parties state that the matter has been amicably settled between the parties, and in terms whereof, counsel for the respondent has handed over a cheque bearing No.132158 for Rs.5,45,500/-, dated 26.05.2016, drawn on ICICI Bank, to counsel for the petitioner in Court today, who has accepted the same in full and final settlement subject to the due encashment thereof.
Counsel for the respondent undertakes to this Court on behalf of his client that the said cheque shall be duly honoured on presentation; and that the respondent shall ensure the availability of funds in the account of the respondent company at all relevant times. This undertaking is accepted by this Court, and the respondent shall remain bound by the same. Counsel for the petitioner states that under the circumstances, he does
not wish to press this petition any further while retaining the petitioner's right to file any fresh petition and to initiate proceedings in contempt in case he is so advised, if the said cheque is dishonoured for any reason. He is permitted to do so.
Counsel for the petitioner further states that this settlement binds the petitioner Firm and its Partners; and nothing further is due from the respondent in respect of the subject matter of this petition. Consequently, and as prayed, the petition along with CA No.2476/2015 is disposed off in the aforesaid terms. SUDERSHAN KUMAR MISRA, J MAY 27, 2016 dr
