O R D E R

% 07.03.2018 By this petition the petitioner seeks quashing of FIR No.808/2016 under Sections 354/354A/509 IPC and issuance of show cause notice and departmental inquiry against the police officers. FIR No.808/2016 was registered on the complaint of Ms.Nisha Dhawan. In the complaint, the complainant alleged that she was residing at House No.134, Bhai Parmanand Colony, Delhi along with her two daughters and her son. Her husband had expired four years ago and her house was in a dilapidated state. Petitioner was residing on the third floor of her house as a tenant. Despite repeated requests for the last one year, petitioner was not vacating the premises and was threatening, abusing and teasing her. It is also alleged that on 22nd August, 2016 the petitioner came in the midnight, W.P.(CRL) 3078/2017

started knocking the door and when the complainant opened the door, the petitioner held her hand with malafide intentions and started molesting her. On screaming, neighbours gathered and the petitioner managed to flee from the spot.

On receipt of the complaint from the complainant, FIR was recorded. The complainant also made a statement before the learned Metropolitan Magistrate under Section 164 Cr.P.C. and on investigation, as informed by learned Additional Standing Counsel, a charge-sheet has since been filed on 27th February, 2018.

Considering the nature of allegations which constitute the offences invoked, this Court finds no ground to quash the FIR or direct any departmental action against the police officers. Petition and the application are dismissed.
