O R D E R

% 10.10.2017 It is submitted that respondent no.2 (complainant) and petitioners are neighbours.

A quarrel took place between them on some trivial issue wherein petitioner no.1 assaulted the respondent no.2 while petitioner nos. 2 and 3 caught hold the complainant/injured resulting injuries to him. The assault was not pre-meditated as quarrel ensued all of a sudden. Now, with the intervention of their common friends and family members, petitioners and respondent no.2 have now settled their disputes amicably vide Compromise Deed dated 25th August, 2017, therefore, FIR No.182/2013 under Sections 307/34 IPC registered at police station Nabi Karim and the consequent proceedings emanating therefrom may be quashed.

Respondent no.2 is present in Court along with his counsel and has been identified by SI Ramesh Chand of police station Nabi Karim. Respondent no.2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion, therefore, he is not willing to pursue the FIR any further and the same may be quashed. Learned APP submits that charge-sheet has been filed and trial is pending.

Keeping in view the settlement arrived at between the petitioners and respondent no.2 voluntarily, in the interest of justice, FIR No.182/2013 under Sections 307/34 IPC registered at police station Nabi Karim and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
