% 06.03.2018 Respondent nos.2 is the father of respondent no.3. FIR No.132/2012 under section 363 IPC was registered at police station Farsh Bazar on the complaint of respondent no.2 wherein he had alleged that his daughter-respondent no.3, then aged about 14 years, was missing from the house. Respondent no.3 was later traced in the company of petitioner.

During investigation, charge sheet has been filed and charges under section 363/366/368/471 IPC have been framed by the trial court and trial is underway.

Respondent no.3, who is present in the court, is now aged about 25 years.

It is submitted that petitioner and respondent no.3 have married and are living together for the last about 5 years. One child has also been born out of the wedlock.

Respondent no.2 submits that he has accepted the marriage between respondent no.3 and the petitioner. Both, that is, respondent nos. 2 & 3 have joined prayer of the petitioner for quashing of the aforesaid FIR.

Keeping in mind the facts and circumstances of this case, as detailed above, I am of the view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice FIR No.132/2012 under Section 363 IPC registered at police station Farsh Bazar and the consequent trial court proceedings emanating therefrom are quashed.
