This is an application for preponement of date of hearing. 2.

The application is allowed and the next date of hearing i.e. 6th February, 2018 stands cancelled.

BAIL APPLN. 1723/2017 1.

By filing the instant application under Section 438 Cr.P.C. the petitioner is seeking anticipatory bail in case FIR No.438/2016 under Sections 420/467/468/120-B, PS Mahendra Park, Delhi. 2.

Vide order dated 18th September, 2017, at request of counsel for the BAIL APPLN. 1723/2017

parties, the matter was referred to Delhi High Court Mediation & Conciliation Centre to explore the possibility of settlement. 3.

Today it has been submitted by learned counsel for the parties that the matter has been settled before the Delhi High Court Mediation & Conciliation Centre vide Settlement Agreement dated 11th December, 2017. Mediation report in respect of the settlement has also been received from the Mediation Centre.

The complainant is present in person along with her counsel and submits that she has already received the amount of `2,00,000/-, receipt to that effect has been annexed with the application as Annexure-A and `8,00,000/-by way of post dated cheques, copy of the same has been placed on record. It is further submitted by the complainant that she will cooperate for getting the FIR quashed in CRL.M.C.5523/2017, which is listed today before another Bench.

In view of the mediation settlement between the parties, it is directed that in the event of arrest, the petitioner be released on bail on his furnishing personal bond in the sum of ₹20,000/- with one surety in the like amount to the satisfaction of IO/SHO concerned. However, the petitioner is directed to join the investigation as and when required by the IO/SHO concerned. 6.

Application is disposed of.

As prayed, copy of the order be given dasti to learned counsel for the petitioner.
