Arun Kumar Mittal v. The State Of Delhi And ORS
$~52 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 7696/2017 & CM 31833/2017 ARUN KUMAR MITTAL ..... Petitioner Through Mr Alok Kumar, Advocate.
versus THE STATE OF DELHI AND ORS ..... Respondents Through Mr Santosh Kr Tripathi, ASC GNCTD for R1.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 01.09.2017 1.
The grievance of the petitioner relates to his alleged interest in the property bearing No.G-118, Gali No.7, Krishna Nagar, near Safdarjung Enclave, New Delhi. The petitioner claims that he has certain interests in the said property, which he states is sought to be alienated by virtue of various documents such as Will, GPA etc. The petitioner prays that the SubRegistrar be restrained from registering such documents without verifying the title to the property.
2.
It is seen that the controversy in the present petition relates to a private dispute regarding the property in question and the Sub-Registrar is not required to entertain that controversy, while registering the documents executed by a party. This court is also informed that the petitioner has also filed a suit and had sought interim orders in those proceedings, which were declined.
3.
In the present case, the court finds no reason to entertain the prayers made in the petition as the same are misconceived.
4.
Accordingly, the petition and pending application are dismissed. Needless to state that this court has not examined the controversy regarding the petitioner's interest in the property in question and the petitioner is not precluded in any manner from agitating his grievance in this regard in appropriate proceedings.
