% 20.09.2017 The petitioner seeks bail in connection with FIR No.284/2008 dated 03.08.2008 (P.S.Punjabi Bagh) pending trial before the Court of learned Additional Sessions Judge-04 (West), Tis Hazari Courts, Delhi in Sessions Case No.57594/2016.

The petitioner was made accused in the aforesaid FIR which was instituted for the offences under Sections 308/323/427/147/148/149 and 34 of the IPC. The petitioner was arrested on 19.08.2008 but was granted bail on 29.08.2008.

The petitioner participated in the trial but for his absence on one day i.e. 27.07.2017, non bailable warrants of arrest was issued against him. On 11.08.2017, when the petitioner presented himself before the Trial Court, his explanation was not accepted by the Trial Court and his bail was cancelled and he was taken into custody on the same day i.e. 11.08.2017.

The petitioner is in custody since the aforesaid date. Considering the facts and circumstances, the petitioner is directed to be released on bail on his furnishing bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the Trial Court. The petitioner shall participate in the trial and would not absent himself from the proceedings unauthorisedly or without seeking permission from the Trial Court.

The application is disposed of.
