O R D E R
% 30.08.2017 It is submitted that petitioner no.1 and respondent no.2 have settled their disputes amicably, therefore, FIR No. 147/2013 under Sections 498A/406/34 IPC registered at police station Sarita Vihar on the complaint of respondent no.2, may be quashed.
Petitioner nos. 2 to 4 are relatives of petitioner no.1.
Respondent no.2 is present in Court and has been identified by SI Malkhan Singh, PS. Sarita Vihar. She admits having settled the matter with the petitioners of her own free will and without any undue force, pressure or
coercion. She further submits that her marriage with the petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, South-East District, Saket Court, New Delhi on 5th June, 2017.
Petitioner no.1 has given a demand draft of `70,000/- to the respondent no.2 today in Court, photocopy whereof has been placed on record .
Respondent no.2 submits that with this payment entire settled amount stands paid.
Respondent no. 2 further submits that she has no objection in case FIR is quashed.
Keeping in mind that marriage between the petitioner no.1 and respondent no.2 has already been dissolved by mutual consent and respondent no. 2 is not willing to pursue the FIR any further, in the interest of justice, FIR No. 147/2013 under Sections 498-A/406/34 IPC registered at police station Sarita Vihar and the consequent proceedings emanating therefrom, are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
