% 19.07.2018 The FIR in this case was lodged in August, 2015. On 07.07.2017, the prosecutrix while appearing in the trial court gave her own age as 18 years as on that date.

This itself confirms and corroborates the ossification test report whereby opinion has been given as to her bony age as 15/16 years at the relevant point of time. In this view of the matter, it cannot be said that the case against the petitioner arising out of FIR No. 426/2015, P.S. Mundka, involving offences punishable under Sections 363/366/476/342 IPC and Section 4 of POCSO Act is ground less.

The petition is dismissed.
