Learned counsel for the respondent points out that in terms of the Agreement between the parties, the exclusive jurisdiction lies with the Courts at Kolkata.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the appropriate Court at Kolkata. The petition is accordingly dismissed as withdrawn with liberty, as prayed for.
