% 30.08.2017 The present petition, under Section 439 Cr.P.C. has been filed on behalf of the petitioner for grant of extension of interim bail, which is going to expire on 31.08.2017.
The said bail was granted by the Trial Court vide order dated 24.08.2017 on the ground that the petitioner's son was admitted in the hospital and that the petitioner's wife was suffering from acute illness. Learned counsel for the petitioner submits that no application for extension of interim bail could be moved before the Trial Court as the order granting bail to the petitioner imposed a condition that the petitioner shall not seek further extension of bail.
Heard.
The interim bail granted by the Trial court is yet to expire on 31.08.2017. Application for grant of extension of interim bail ought to have BAIL APPLN. 1720/2017
been moved before the Trial Court and hence the same is not maintainable in this Court.
In the circumstances, the counsel for the petitioner is at liberty to move an application for interim bail before the concerned Trial Court who shall deal with the same in accordance with law.
