The petitioner has filed the present petition, inter alia, praying that direction be issued to respondent no.1 to carry out the necessary procedure for transplantation of the Kidney at the earliest. 4.

The petitioner has been advised to undergo a procedure for kidney transplantation as his kidneys have failed. The petitioner states that he has located a suitable donor, however, the respondent no.1 hospital is not taking any action for undertaking the said procedure. The donor located by the petitioner is admittedly not a close relative, however, it is stated that he is a

close friend and has been staying with the petitioner for the past 13 years. 5.

In the circumstances, respondent no.1 is directed to refer the matter to the Authorization Committee constituted under the Transplantation of Human Organs and Tissues Act, 1994. The Authorization Committee would take an informed decision as expeditiously as possible having regard to the decision of this Court in Praveen Begum & Anr vs Appellate authority & Anr : (2012) 189 DLT 427.
