% 06.12.2017 Mr. Rajni Kant Uniyal, Authorised Representative of respondent no.2 is present in Court. He submits that matter has been settled between the petitioners and respondent no.2 amicably vide Memorandum of Understanding Dated 10th October, 2005.
He further submits that settled amount of `25 lacs has already been received by the respondent no.2. NOC issued by the respondent no.2 has been placed on record at pages 36 to 38. Respondent no.2 further submits that respondent no.2 has no objection in case FIR is quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 and that settled amount stands paid, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending which relates to loan transaction. Accordingly, in the interest of justice, FIR No.73/2005 under Sections 420/120-B IPC registered at police station Connaught Place and the consequent charge emanating therefrom are quashed.
Petition is disposed of in the above terms.
