Mr. Sudeep Sudan, learned counsel appearing for the respondent no.1/Pratik Jindal submits that in Contempt Case (C) No.440/2017, Mr. Sanjay Kumar and Ms. Mamta were the petitioner nos.1 & 2 respectively. He states that according to the Settlement Agreement, a sum of Rs.35 Lakhs in all was to be released to the present petitioner Kewal Krishan Gahlot. He states that out of the said amount, a sum of Rs.19 Lakhs already stands paid and that the same may be affirmed from the learned counsel appearing for the petitioner.

Learned counsel for respondent no.1 states that it appears that due to inadvertence, the respondent had deposited two(2) Demand Drafts of Rs.16 Lakhs each in the name of the Registrar General of this Court in Contempt Case (C) No.440/2017. He states that out of those two Demand Drafts, one Demand Draft to the extent of sum of Rs.16 Lakhs, according to the Settlement Agreement, is to be released to Mr. Kewal Krishan Gahlot. sum to Mr. Kewal Krishan Gahlot was directed to be done in Contempt Case (C) No.440/2017. He also states that there is no sum deposited in Contempt Case (C) No.869/2018. He prays that the said sum of Rs.16 Lakhs alongwith interest accrued thereon, presently in the name of the Registrar General of this Court be released to Mr. Kewal Krishan Gahlot in terms of the Settlement Agreement dated 5th April, 2024.

Mr. Chauhan, learned counsel appearing for the petitioner affirms the aforesaid submission. He states that the petitioner has indeed entered into a Settlement Agreement dated 5th April, 2024 with the respondents. He too prays that appropriate directions for release of the aforesaid Demand Draft be passed. He also affirms the receipt of Rs.19 Lakhs previously from the respondents herein.

In view of the aforesaid submissions, the Registry is directed to release the Demand Draft of Rs.16 Lakhs deposited by the respondents to the present petitioner within two weeks from today upon completion of all the formalities in that regard. The accrued interest thereon too shall be released to the petitioner.

The photocopy of the Settlement Agreement dated 5th April, 2024 is taken on record.

The Office Note is closed and the Contempt Case(C) No.869.2018 is disposed of as settled.
