CM. No. 17914/2018 This is an application filed by the respondent No.4 Mr. Sachin Kumar Gupta with the following prayer:
"It is therefore, most respectfully prayed that Hon‟ble Court be pleased to stay/direct the respondent Nos.1 to 3 not to seal/demolish the legal and unauthorised portion of the property as it would cause grave injustice to the respondent No.4 in the interest of justice."
It is the submission of the learned counsel for the applicant / respondent No.4 that the respondent No.4 has apprehension that the respondent Nos.1 to 3 may also seal / demolish the legal and authorised portion of the property.
During the course of hearing, learned counsel for the respondent No.4 on instructions states, the respondent No.4 on his own shall demolish the unauthorised construction and encroachment and bring the property within parameters of the Standard Plan within one month. The said statement is taken on record. In view of the statement made, nothing further survives in the contempt petition. If there is any inaction on the part of the respondent No.4, liberty is with the petitioner to revive the contempt petition. Application stands disposed of. The date already fixed stands cancelled.
