CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 28.02.2018 By this petition the petitioners seek quashing of FIR No. 687/2017 under Sections 323/341/365/506/34 IPC registered at PS Samaipur Badli on the complaint of respondent No.2 and the proceedings pursuant thereto on the ground that parties have settled the matter. The above-noted FIR was registered after an information was received from BJRM Hospital regarding admission of one Rajesh after a quarrel. Statement of Rajesh Rana was recorded who stated that on 7th August, 2017 at about 12 midnight while he was going to his house one Kutthu, S/o Balwan called him near to his car where he along with his associates Raja, Nanhe and two other persons were consuming liquor in the W.P.(CRL) 2507/2017

car. Kutthu asked him to give his mobile phone and when he refused, the five persons caught hold of him and beat him mercilessly. When he was unconscious they put him in their car and threw him near the boundary of the hospital.

Considering the nature of allegations which include kidnapping, this Court finds no ground to quash the above-noted FIR on the basis of compromise.

Petition is dismissed.
