CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 26.11.2018 Respondent no.2- Surender Singh is present in Court and has been identified by SI Yogesh Kumar of police station Vivek Vihar. Respondent no.2 submits that he has settled the matter with petitioner of his own free will and without any undue force, pressure or coercion, vide Memorandum of Understanding/Settlement Agreement dated 11.08.2017. He further submits that he has no objection in case FIR No. 0949/2015 under Sections 308/34 IPC registered at police station Vivek Viihar is quashed. Affidavit of respondent no.2 is also on record to this effect. Keeping in mind the settlement arrived at between the petitioner and

respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
