% 12.12.2017 Notice could not be issued to the respondent no.2 as process fee was not filed. However, respondent no.2 appears in person and accepts notice. She has been identified by SI Sandeep Sharma of police station Vasant Kunj North.
Respondent no.2 submits that she has settled the matter with the petitioner vide Memorandum of Understanding (MOU) dated 24th August, 2017 of her own free will and without any undue force, pressure or coercion, therefore, she is not willing to pursue the FIR any further and the same may be quashed. Affidavit of respondent no.2 is also on record. She also admits her signatures on the MOU.
Keeping in mind that a settlement has been arrived at between the petitioner and respondent no.2 voluntarily, in the interest of justice, FIR No.
615/2014 under Sections 323/341/427/506/509 IPC registered at police station Vasant Kunj North and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
