% 12.09.2017 Learned counsel for the petitioner submits that matter has been settled between the petitioner and respondent no.2 (BSES), inasmuch as entire settled amount has been paid; therefore, FIR No.1326/2016 under Sections 135 of the Indian Electricity Act (Amend), 2003 registered at police station Mehrauli on the complaint of respondent no. 2, may be quashed. Learned counsel for the respondent no. 2 is present in Court along with Mr. Pradeep Bisoya, Authorised Representative and submits that he has instructions from the respondent no. 2 to state that matter has indeed been settled with the
petitioner, inasmuch as entire settled amount has been paid. He further submits that respondent no. 2 is not willing to pursue the FIR any further and the same may be quashed.
Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in the interest of justice, FIR No.1326/2016 under Sections 135 of the Indian Electricity Act (Amend), 2003 registered at police station Mehrauli and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
