% 11.04.2018 By this petition the petitioner seeks parole and challenges the communication dated 3rd January, 2017 rejecting his application seeking parole to look after the ailing father and to maintain social ties. On a notice being issued, a Status Report has been handed over in Court, which is taken on record. As per the Status Report, besides FIR No.158/2012 under Section 376 IPC wherein the petitioner is undergoing life imprisonment, the petitioner was also arrested in case FIR No.168/2012 under Sections 363/366 IPC for enticing 11⁄2 year old girl for sexually assaulting her. Further, the address of the petitioner's family was not verified as the petitioner's family had left the said address 4-5 years ago. W.P.(CRL) 2525/2017

Since the address of the petitioner's family was not verified, this Court directed production of the petitioner. Petitioner has been produced in Court. He has supplied fresh address of his family being WZ-669, 1/3, Naraina Village, Delhi. No medical documents of the ailment of the petitioner's father have been annexed. Further, the younger brother of the petitioner is a major who can look after the ailing father.

Considering that the brother of the petitioner is there to look after his ailing father, this Court finds no ground to set aside the order dated 3rd January, 2017 and grant parole to the petitioner. However, the petitioner would be at liberty to apply for parole afresh for the reason the earlier application was filed more than a year ago.

Petition is dismissed.

A copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
