% 27.02.2018 Vide the present petition, the petitioner seeks quashing of orders dated 18.04.2017 and 30.09.2016 passed by respondent Nos.1 and 2 respectively whereby the petitioner's requests for grant of extension by a few months for conducting the inspection was not acceded to and on this ground alone, the petitioner's application was rejected.
Learned counsel for the petitioner submits that the petitioner had for valid reasons requested the respondents to grant extension of time for carrying out inspection of the petitioner's premises. He submits that in view of the decisions of this Court, once the petitioner was willing to deposit the inspection fee and had requested the
respondents to conduct the inspection subject to the petitioner depositing the inspection fees, the respondents ought to have considered the petitioner's request for inspection of the petitioner/institute.
Learned counsel for the respondent is unable to dispute the position that in such circumstances, where the institutes have made request for grant of extension of time for inspecting the premises, this Court has taken a view that such requests should be entertained sympathetically.
Accordingly, the impugned orders dated 18.04.2017 and 30.09.2016 passed by respondent no.1 & respondent no.2 respectively, are quashed and subject to the petitioner depositing the inspection fees and fulfilling all other criteria, the respondents would inspect the petitioner's institute within 8 weeks. Needless to say that the Court has not opined on the merits of the petitioner's application.
