% 13.11.2018 At the outset, Mr.Chadha, learned APP submits that the present petition is not maintainable as the petitioner has a statutory remedy under Section 397 Cr.P.C., to approach the learned Sessions Court. In view of the aforesaid objection taken by Mr.Chadha, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach the learned Sessions Court. The petition and pending application are dismissed as withdrawn with liberty as prayed for.
