% 23.11.2017 Petitioner has prayed for quashing of FIR No.137/2015 registered at police station Defence Colony. FIR has been placed at page 45 which was registered under sections 342/506/509/34 IPC, on the complaint of Ms. Anjuman Joshi, respondent no.2. It is submitted that charge sheet has been filed under sections 341/342/506/509/34 IPC.

It is submitted that petitioner no.1 and respondent no.2 have now settled their disputes before the Mediation Centre, Saket Courts, Delhi vide Memorandum of Understanding dated 5th August, 2017. Mediation report has also been placed on record as (Annexure P-2). A perusal of mediation report reveals that the subject matter involved in this FIR has already been settled, besides other litigationas. Respondent no.2 had appeared before the Court on 5th September, 2017 and had stated that she has settled the matter with

petitioners in terms of Memorandum of Understanding dated 5th August, 2017, of her own free will, without any force, pressure and coercion. She stated that she has no objection if the aforesaid FIR is quashed.

A cumulative reading of mediation report and statement of respondent no.2 as contained in order dated 5th September, 2017, clearly shows that petitioners and respondent no.2 have settled their disputes voluntarily.

Keeping in view the facts and circumstances of the case as detailed above, in the interest of justice, FIR No.137/2015 under sections 341/342/506/509/34 IPC registered at police station Defence Colony and the consequent proceedings emanating thereform are quashed.

Petition is disposed of in the above terms.
