By way of this petition filed under Section 439(2) read with Section 482 Cr.P.C., petitioner is seeking cancellation of bail granted to the accused/respondent No.2 by this Court vide order dated 11th May, 2017. 2.

Status report on behalf of the State has been filed as per which on 8th September, 2017 information regarding detention of alleged Dalbir Singh, respondent No.2 herein at IGI international airport was received from Immigration Department and later on he was entrusted to Delhi Police. During interrogation from Dalbir Singh, it was revealed that he had left the country on 12th June, 2017.

Respondent No.2, Dalbir Singh is present today in Court along with his counsel and explained the circumstances and misunderstanding under CRL.M.C. 3544/2017

which he left the country during the period of 12th June, 2017 to 8th September, 2017. He has also filed an affidavit cum undertaking stating therein that he will not violate any of the conditions imposed vide order dated 11th May, 2017 while granting bail to him. 4.

Learned counsel for the respondent No.2 has today explained all the conditions imposed vide order dated 11th May, 2017 to respondent No.2 in Court.

In view of the affidavit cum undertaking, the petition seeking cancellation of bail granted to the accused/respondent No.2 by this Court vide order dated 11th May, 2017 is dismissed. PRATIBHA RANI, J.
