CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 20.03.2018 Respondent no.2 Sh.M.A.Hasan is present in court. He is a lawyer. He submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion. He has no objection in case FIR No.259/2016 under Section 380 IPC registered at police station Jamia Nagar is quashed.
Memorandum of Understanding dated 5th May, 2016 is placed on record, inasmuch as the settled amount has already been paid.
Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the
interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
