The petitioner has challenged the award of the Labour Court whereby compensation of Rs.50,000/- has been awarded to the respondent for illegal/unjustified termination of the services. 2.

The main ground of challenge of this writ petition is that petitioner availed the services of respondent through the Contractor, M/s Pivot Industries Service Pvt. Ltd.

This Court is of the view that no interference in the impugned award is warranted and the petitioner is at liberty to recover the award amount from the Contractor, M/s Pivot Industries Service Pvt. Ltd. in accordance with the law.

The writ petition is dismissed. The pending application is also disposed of. Interim order is vacated.

The amount of Rs.50,000/- deposited by the petitioner be released to the respondent along with interest accrued thereon. The petitioner shall make the payment of litigation expenses of Rs.15,000/- to the respondent

within a period of three weeks from today. The said payment be made by means of a cheque in the name of respondent and be sent by registered AD Post at the following addresses:- Mr. Jata Shankar(respondent) S/o Sh. Ramai Ram, Village Naraina, Post Hargargh Bazar, District Marzapur, U.P.
