With the consent of the parties, the present petition is taken up for final disposal.

The petitioner has aggrieved by the order dated 14.09.2018 whereby the CIC has imposed penalty of Rs.25,000/- on CPIO and Rs.5,000/- upon the First Appellate Authority for providing the information after delay of 15

days. The main grievance of the petitioner is that CIC has imposed costs on the grounds that CPIO and First Appellate Authority have not provided the enclosures sought by the respondent.

The fact remains that the CPIO relieved from the said post on 01.12.2017 and retired from the services on 31.01.2018. Therefore, I find no lapses on the part of the CPIO and, accordingly, the order dated 14.09.2018 passed by the CIC is hereby set aside as the costs is concerned. The petition is, accordingly, allowed.
