O R D E R

% 14.09.2017 Petitioner no.1 is wife of petitioner no.2.Learned counsel for the petitioners submits that petitioners had not sold the subject property to Mahesh Rathi, infact, had sold the same to the complainant. He further submits that original documents of the property as well as the possession were handed over to the complainant.. Petitioners had taken loan from Mahesh Rathi in the year 2009 and had singed certain papers, which were subsequently fabricated by Mahesh Rathi as sale documents. It is further submitted that complainant is in possession of the suit property as of now. Learned APP, on the instructions of the Investigating Officer, has not disputed the fact that complainant is in possession of the suit property.

Keeping in mind totality of the facts and circumstances, it is ordered that in case of arrest, petitioners be released on bail subject to their furnishing a personal bond in the sum of `10,000/- each with one surety each in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station. Bail application is disposed of.
