O R D E R

% 14.02.2019 This revision petitioner challenges the impugned order dated 30.07.2018 passed by the learned SCJ cum RC (Central) Tis-Hazari Courts, Delhi in eviction petition E-78939/2016 filed by the petitioner under section 14(1)(e) of the DRC Act.

Vide the impugned order the application for leave to defend filed by the petitioner was dismissed and the eviction order was passed. During the arguments it was submitted by the learned counsel for the petitioner that the petitioner does not intend to challenge the eviction order on merits provided she be given five years time to vacate the premises, which is objected to by the learned counsel for the respondent, hence, as agreed, the petitioner is directed to vacate the premises and handover its peaceful possession to the respondent

on or before 15.02.2021 subject to payment of user/occupation charges @ 10,000/- per month with effect from 01.02.2019 till vacation of the premises. The user/occupation charges shall be paid to the respondent by 7th day of each calendar month. User/occupation charges of this month shall be payable on or before 7th day of March 2019 alongwith the user/occupation charges for the month of March 2019. Electricity and water charges shall be paid as per actuals. Usual undertaking shall be filed within four weeks from today. Any violation of the undertaking shall entail eviction forthwith. The petition and pending application, if any, stands disposed of in terms of the above.
