W.P. (C) No.7885/2017 & C.M. No.32570/2017 The petitioner has filed the present petition impugning the order dated 8.8.2017, and the order dated 11.4.2017, whereby the petitioner was directed to deposit a sum of ₹5 lacs without prejudice to his rights and contentions.
Mr. Barqi, learned counsel for the petitioner states that the petitioner is a young person of about 21-22 years of age and does not have the wherewithal to make the deposit as required. This court does not find the condition put forth by the Appellate
Tribunal is in any manner unreasonable, and no interference would be warranted.
At this stage, Mr. Barqi states that the petitioner would deposit the amount; however, would require further time to do so. He also states that the petitioner would deposit a sum of ₹2 lacs within a period of four weeks and the balance, subsequently. In view of the statement made of Mr. Barqi, the impugned order is modified to the extent that the time for making such deposit is extended by a further period of 12 weeks from today. The petitioner would deposit a sum of ₹2 lacs within a period of four weeks from today and the balance amount would be deposited within a period of eight weeks thereafter.
The petition is disposed of with the aforesaid directions. Dasti.
