% 31.07.2018 The appeal is directed against the order of the learned Single Judge thereby condoning the delay in filing the written statement alongwith counter claim by the defendants. It was submitted by learned counsel for the defendant that the winding up proceedings have been initiated against the defendant company and the Official Liquidator is the incharge of its affairs. Given this circumstance, we are of the opinion that no interference is called for with the impugned order. However, at the same time, the plaintiff would be at liberty to take appropriate steps substituting the record of the suit by impleading the Official Liquidator in accordance with law.
