W.P.(C) 12152/2018 with CM APPL. 47171/2018 (for stay) Issue notice. Mr. Arun Bhardwaj, Advocate accepts notice on behalf of the respondent No.1. In view of the order that we propose to pass, we do not consider it necessary to issue notice to other respondents. The Central Administrative Tribunal, Principal Bench, New Delhi ('the Tribunal') dismissed the petitioner's original application i.e. OA No.4049/2016 vide impugned order dated 08.10.2018. While dismissing the same, the petitioner has been subjected to costs of Rs.50,000/- to be paid to
the Prime Minister's Relief Funds within four weeks from the date of the said order.
The submission of the petitioner is that his original application had become infructuous.
The Tribunal has dismissed the original application while imposing the costs.
In our view, the Tribunal was not justified in subjecting the petitioner to the said costs.
Accordingly, we modify the impugned order to the extent that it imposes costs of Rs.50,000/-. The costs of Rs.50,000/- is hereby waived off.
