% 15.11.2018 Learned counsel for the petitioner submits that even though the petitioner had withdrawn his earlier petition on 30.08.2018 only because of non-filing of relevant documents with the petition, but due to an inadvertent oversight on his part, he did not seek liberty to file a fresh petition. It has been put to learned counsel for the petitioner, as to how in the light of dismissal of his earlier petition, the present petition seeking the same relief would be maintainable. At this stage, learned counsel for the petitioner seeks liberty to withdraw the present petition to move an appropriate application in Crl.M.C. No.2757/2018 which was withdrawn on 30.08.2018.

The petition is dismissed as withdrawn along with the pending application with leave as prayed for.
