% 11.12.2017 Mr. Atul Kumar, Advocate has appeared on behalf of the CBSE. He states that minimum 75% attendance in class 10th is required to be completed by 31st January of the year in which the examination is to be held. Since Firdaus has not attended any class for the current sessions i.e., 2017-2018, she would not be in a position to take the examination in 2018. Moreover, the last date for filling up the board examination form for class 10th has already passed. Firdaus states that she is willing to go back with the petitioner and to live with her on the condition that she is permitted to meet Akash whenever she wishes. We have inquired from the petitioner

whether she would be willing and ready to allow Firdaus to meet Akash, to which she has replied in the affirmative. With this assurance, Firdaus is returned to the petitioner - mother from the court itself.

The petitioner is directed not to pressurise Firdaus to marry any person before she attains the age of majority and against her will. The petitioner has also given assurance to this court in this regard. We direct the SHO, Police Station Subhash Place to depute a lady constable to make inquiries with regard to the well being of Firdaus by visiting the residence (in civil uniform) on a weekly basis for the first two months and thereafter, on monthly basis, if the situation is found to be in order. Mobile phone of the SHO and the lady constable so deputed, be provided to Firdaus so that, in case she makes any grievance, the same could be attended to without any delay.

With aforesaid directions, the present petition is disposed of. A copy of this order be given dasti under signatures of court master.
