% 22.09.2017 W.P.(C) 7913/2017 The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India.

As per the writ petition, the petitioner is vending outside Punjab and Sind Bank, near Bharat Petrol Pump, Green Park, New Delhi on the cycle as per the photograph placed at page 58 of the paper book. The grievance of the petitioner is that he is not being allowed to vend by the official of the respondents in the aforesaid area. Mr. Peechara, learned Standing Counsel for SDMC submits that, SDMC-respondent No.1 is now following a uniform policy in not allowing the street vendors to vend on any of the main roads, as it

leads to obstruction in free-flow of traffic, and great inconvenience to pedestrians and can also result in fatal accident(s). He further submits that challans which have been initially filed show that the petitioner was hawking near Uphar Cinema, Green Park and he has been subsequently moved from the initial site to the present site.

At this stage, learned counsel for the petitioner submits that petitioner would now vend at his initial site i.e. Uphar Cinema, Green Park, New Delhi for which learned counsel for the SDMC submits that his client has no objection and in case of any violation, suitable action will be taken.

In view of the above, the writ petition is disposed of. CM No.32698/2017 Application stands disposed of in view of the order passed in the writ petition.
