% 12.02.2018 After some arguments, learned counsel for the petitioner submits that he may be granted leave to withdraw the petition with liberty to file an appropriate appeal before the Deputy Commissioner, Kapashera under section 64 of the Delhi Land Revenue Act, 1954. He further submits that the necessary appeal will be filed by the petitioner within two weeks, but requests that keeping in view the nature of the matter, directions may be issued for expeditious disposal of the appeal to be filed by the petitioner. Learned counsel for the respondents do not oppose the prayer made by the petitioner. It is accordingly directed that in case an appeal is filed by the petitioner before the concerned Deputy Commissioner within two weeks, it will not be treated as barred by limitation or by delay and it
would be heard and decided on merits. It is hoped that keeping in view the short controversy raised in the petition, the concerned Deputy Commissioner would decide the appeal expeditiously and preferably within a period of eight months.
The petition alongwith pending application is accordingly dismissed as withdrawn with the aforesaid liberty. REKHA PALLI, J FEBRUARY 12, 2018 sr
