MAT.APP.(F.C.) 301/2018 and CM APPL. 48274/2018 (Stay) Challenge in this appeal is to the order dated 26.09.2018 by which the Family Court has awarded maintenance for the five year old daughter of the appellant @12,000/- per month. It is an admitted position that the appellant and his wife are earning.

After some hearing in the matter, while the appeal is not pressed, learned counsel for the appellant submits that he would like to seek modification of the order passed by the Family Court to the extent that part of the amount awarded for maintenance should be kept in a fixed deposit in the name of the child.

While, the appeal is dismissed as not pressed, in case such an application is filed before the Family Court, we hope the Family Court would consider the same in accordance with law. Pending application stands disposed of accordingly.
