with petitioners in person.
versus STATE OF NCT OF DELHI & ANR.
..... Respondents Through:
Mr. M.S. Oberoi, APP for State with SI Vijay Singh, P.S. Prashant Vihar.
Respondent no.2 in person.
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 19.12.2017 Respondent no.2-Smt. Sarita is present in Court and has been identified by SI Vijay Singh of police station Prashant Vihar. Respondent no.2 submits that she has settled the matter with her husband, that is, petitioner no.1 of her own free will and without any undue force, pressure or coercion. She further submits that she is living with the petitioner no.1 for the last three years, therefore, she is not willing to pursue the FIR any further and the same may be quashed against all the petitioners. Keeping in view that husband (petitioner no.1) and wife (respondent no.2) have started living together after resolving their differences, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending.
Accordingly, in the interest of justice, FIR No.
497/2002 under Sections 498A/406/34 IPC registered at police station Prashant Vihar and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
Dasti.
