This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "a. Pass a writ of mandamus or any other writ for directing the official Respondents to award UNIVERISTY MEDAL to Petitioner No. 1 and PROF. SAVITRI SINHA SMRITI SWARNA PADAK and MAITHILI SHARAN GUPTA PURASKAR to Petitioner No. 2 in view of the Petitioners manifestly fulfilling the criteria of securing highest/maximum marks in their respective courses.

b. To quash the merit no. Exam -IV /2018/degree/delhi and all subsequent merit lists issued by the official Respondents arbitrarily excluding the names of the Petitioners. c. To declare E.C resolution no. 122(6) dated 06/03/2014 as The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Restraining the official Respondents to confer the UNIVERISTY MEDAL to Respondent No. 5 and PROF. SAVITRI SINHA SMRITI SWARNA PADAK and MAITHILI SHARAN GUPTA PURASKAR to the Respondents No.6. e. Pass any other order (s) as this Court deem fit and proper in the facts and circumstances of the case and in the interest of justice."

The brief facts of the case are that the petitioner No. 1 secured admission in B.Sc (Hons.) Botany for the academic session 2014-2017. The petitioner No. 2 secured admission in M.A. (Hindi literature) for the year 2015-2017 in Hindu College.

When the results were declared, the petitioner No. 1 securing 3254 marks out of 3500 marks. Dissatisfied with the final semester result, the petitioner No. 1 applied for revaluation on 06.09.2017. 4.

Similarly, petitioner No. 2 secured 1096 out of 1600 marks in the results declared for M.A. (Hindi) and again being dissatisfied from the result applied for revaluation.

After revaluation the marks of the petitioner No. 1 increased to 3273 and the marks of the petitioner No. 2 increased to 1108. Hence, both the petitioners were declared as toppers on 15.02.2018 by the college. 6.

However in the list of awardees i.e. the list for University Medal for the B. Sc (Hons.) Botany course and List for Prof. Savitri Sinha Swaran Padak and Maithili Sharan Gupta Puraskar for the M.A. (Hindi) course, the respondent Nos. 5 and 6 were declared as awardees who had secured the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

highest marks when the result was first announced before revaluation. 7.

The stand of the university was based on E.C. Resolution No. 122(6) Dated 06/03/2014, which reads as under:- 8.

Mr. Manchanda, learned counsel for the petitioner, states that the said resolution has already been quashed on 06.04.2022 by this Court in Annie Gurmeher Kaur v. University of Delhi passed in WP(C) 2503/2021. 9.

In the present case, the award is to be given to the student who has scored the highest. Admittedly, the petitioner has secured the highest marks through re-evaluation.

In this view of the matter, there is no denying the fact that the petitioner No. 1 is the highest scorer in B.Sc (Botany) and the petitioner No. 2 is the highest scorer in M.A. (Hindi) and must be given the due recognition.

do complete justice, therefore, it is ordered as follows:- a) The petitioner No. 1 shall be awarded the University Medal in B.Sc (Botany) for the academic session 2014 to 2017. b) The petitioner No. 2 shall be awarded with Prof. Savitri Sinha Smriti Swarna Padak and Maithili Sharan Gupta Puraskar for M.A. (Hindi) session 2015 to 2017. 12.

In view of the above two directions, Mr. Manchanda, learned counsel for the petitioner does not claim any financial benefits arising from the said award.

Since respondent Nos. 5 and 6 were awarded the Awards in the year 2018 and were entitled to the said award, at that point in time, and since respondent Nos. 5 and 6 have already got the same in accordance with the relevant rules prevalent at that point in time, the same need not be withdrawn from the respondent Nos. 5 and 6, rather the petitioners shall be additionally given the said Awards.
