% 26.11.2018 The grievance of the petitioner appearing in person is that though the ex parte judgment dated 02.09.2015 has been passed against him and he though is inclined to file an application under Order IX Rule 13 CPC, but the learned Trial Court concerned is not accepting such application.

No notice is required to be issued to the opposite party. The petition stands disposed of with a direction to the learned Trial Court to allow the petitioner to file application before the Court and decide it on merits. In case there exist any forum to file such applications, the petitioner be directed to follow such procedure. Copy of this order be given dasti to the petitioner under signature of the Court Master.
