O R D E R
% 03.05.2018 After some arguments, the learned counsel for the parties state upon instructions that the lis has been amicably settled in the following terms:- (i) the appellant shall pay an amount of Rs.2,00,000/- towards full and final settlement of all claims of the respondent apropos the lis. This amount shall be paid in four equal instalments of Rs.50,000/- each. The first instalment of Rs.50,000/- shall be paid on or before 15.05.2018 into the bank account of the respondent bearing No.50200010326068 maintained with HDFC Bank, Darya Ganj Branch, Delhi. The remaining three instalments shall be paid on or before 31st May, 15th June and 30th June, 2018 into the aforesaid bank account of the respondent. Any infraction in payment of the amount, either by the dates specified or in terms of the quantum shall be visited with costs of Rs.10,000/- for each infraction. The cost amount too shall be deposited in the said account;
(ii) Upon receipt of the entire amount, all complaints, claims, suit and other proceedings filed or pursued by the respondent against the appellant or its proprietor shall be withdrawn and the respondent shall assist in quashing of such proceedings.
The learned counsel for the parties state that the parties undertake to abide by the terms of the settlement. An affidavit of undertaking shall be filed by the parties within a week.
The appeal, alongwith pending application, stands disposed off in the above terms.
