% 26.10.2017 CM No. 36538/2017 (early hearing) It is an application seeking early hearing. Ld. Counsel for the respondent has no objection. Application is allowed and is disposed off accordingly. As jointly prayed, matter is taken up for hearing today itself. Date earlier fixed for 8.12.2017 stands cancelled. W.P.(C) 8812/2017 By the petition, the petitioner seeks issuance of a Writ of Certiorari seeking quashing of the cancellation of lease deed in respect of the property bearing plot no.7, Block A, Wazirpur, Industrial Area allotted to M/s Maharashtra Soap Factory and the consequential reliefs. During the course of hearing, ld. Counsel for the DDA does not dispute that there is a liberalized policy dated 5.5.2016 and the case of the petitioner can be considered there-under,

if, the terms and conditions under the policy are fulfilled. If that is so, the instant petition can be treated to be a representation for the purpose.

In view of the foregoing, it is directed that the instant petition be treated as a representation of the petitioner for the purposes of the reliefs prayed, to be decided on its own merits by the concerned Commissioner, by a speaking order, as expeditiously as possible, preferably, within six weeks from today. Petition stands disposed off accordingly.
