% 13.12.2017 After some arguments learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an application before the learned Trial Court to recall the order declaring the petitioner as proclaimed offender for the reason the other co-accused has since been discharged in the FIR by the learned Trial Court holding that the ingredients of offence punishable under Section 3 of the Maharashtra Control of Organized Crime Act, 1999 (in short the MCOCA) are not made out. Leave and liberty granted. Petition is dismissed as withdrawn.
