% 11.09.2017 This is a petition filed under Section 27 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the Act) seeking assistance of the Court in summoning the witnesses of the petitioner. It is seen that there is no approval taken by the Tribunal as is the prerequisite under Section 27 of the Act.
Learned counsel for the petitioner submits that the tribunal had orally consented for the approval. He prays for leave to withdraw the petition with liberty to approach this court after obtaining a specific approval of the Arbitral Tribunal in terms of Section 27 of the Act. In view of the above, the petition is dismissed as withdrawn with liberty as prayed for.
