% 05.12.2017 Counsel for the petitioner submits that he restricts to the prayer (in the first line of third para of the impugned order dated 21.07.2017 "Although the parties are residing together in the same house") of the petition only to the observation made by the Principal Judge, Family Court, Tis Hazari Court and he has filed an affidavit on record today in this regard. On instructions, learned counsel for the petitioner submits that he wishes to withdraw the present petition with liberty to file a fresh petition. Leave as prayed for, is granted.

The present petition alongwith pending application is dismissed as withdrawn.
