% 14.11.2017 It has been pointed out by the learned counsel for the respondent that final arguments are to commence before the learned Arbitrator in January, 2018 and the matter would soon attain finality. In view of the above submissions of learned counsel for the respondent, learned senior counsel for the petitioner, on instructions, submits that without prejudice to rights and contentions of the petitioner and keeping all the issues open for final adjudication before the learned Arbitrator, he would like to withdraw the present petition. The instant petition was filed seeking to impugn the order dated 7th June, 2017 that was passed by the learned Arbitrator under Section 17 of the Arbitration "& Conciliation Act, 1996.
It is manifest that any observation made by the learned Arbitrator are prima facie in nature would not bind the parties at the time of final adjudication of the matter.
Accordingly, leave and liberty as sought by the learned counsel for the petitioner, is granted and the present petition is dismissed as withdrawn. JAYANT NATH, J NOVEMBER 14, 2017 sm
