% 11.02.2019 By this petition the petitioner seeks bail in case FIR No. 97/2012 under Section 302/201 IPC registered at PS Prasad Nagar. The evidence against the petitioner is based on circumstantial evidence. Since the petitioner was in custody from 26th May, 2012 and the trial had not concluded, this Court had called for a report from the learned Trial Court which has been received. As per the report, out of 40 prosecution witnesses 37 witnesses are under examination. Learned APP for the State on instructions submits that the 37th witness is the investigating officer and the last witness and no further witness has to be examined by the prosecution. BAIL APPLN. 2708/2018

Considering the fact that the last witness is under examination, the learned Trial Court is directed to expedite the trial and conclude the same by recording of the entire evidence including defence evidence preferably within a period of four months from the next date before the learned Trial Court.

Petition is disposed of.
