Learned counsel for the petitioners has filed a copy of the order dated 19.11.2018, passed by the learned Metropolitan Magistrate, NI Act/South/Saket, New Delhi on record. 2.

Learned counsel for the petitioners submitted that notice under Section 251 of the Code of Criminal Procedure, 1973 stands served upon the accused, to which accused has pleaded not guilty and claimed trial and further disclosed his defence. Learned counsel for the petitioners further submitted that he has already filed an application for dismissal of the complaint, which is now fixed for 23.1.2019 for filing of reply and disposal thereof. Learned counsel for the petitioners further submitted that in view of the subsequent developments, after filing of the present petition, the petitioners may be allowed to withdraw the present petition, with liberty to challenge the

summoning as well as notice, if any adverse order is passed against the petitioners at the time of disposal of the application. 3.

Accordingly, the petition is dismissed as withdrawn, with liberty as prayed. Pending application is also dismissed as withdrawn.
