HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 16.11.2018 Crl. M.A. 47446/2018 (Early Hearing) Notice.

Learned APP accepts notice for respondent no.1.

Respondent no.2 is also present in Court along with her counsel, who accepts notice. Learned APP as well as counsel for respondent no.2 have no objection in case the matter is taken up today after pre-poning the date of hearing. Application is allowed and matter is pre-poned for today. Date fixed in the matter, that is, 10.12.2018 stands cancelled. Application is disposed of.

Crl. M.C. 5714/2018 Respondent no.2 submits that she has settled the matter with

petitioners of her own free will and without any undue force, pressure or coercion vide MOU/Compromise Deed dated 13.11.2018. She submits that she has no objection in case FIR No.

107/2018 under Sections 354/385/506/509 IPC registered at police station Civil Lines is quashed. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.

Petition is disposed of in the above terms.
